These Terms of Use (“Terms”) govern your access to and use of any website, product, service, mobile application, or software provided by Dead Set Digital (“we,” “our,” or “us”), including but not limited to our marketing services, mobile apps (such as BudgetSnap), websites, and custom tools.

By accessing or using any of our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

1. Use of Services

You may only use our websites, software, and digital services for lawful purposes. You agree not to:

  • Interfere with or disrupt service functionality or security
  • Copy, modify, distribute, or reverse engineer our software or code
  • Attempt unauthorized access to any platform or account
  • Use our services to transmit spam, malware, or harmful content

We reserve the right to restrict or terminate access at our sole discretion if these terms are violated.

2. Intellectual Property

All content, code, branding, designs, and tools provided by Dead Set Digital are protected by copyright, trademark, and other laws. Unless otherwise stated in writing, we retain ownership of:

  • Custom code and frameworks
  • Website or app designs created under contract
  • Internal tools and proprietary processes

Client content remains the property of the client, but use of our systems does not grant rights to reuse, resell, or redistribute our work beyond the agreed project scope.

3. Client Services and Custom Work

For digital marketing, app development, and client-based work:

  • Project scopes, timelines, and deliverables are defined in separate written agreements or invoices
  • All services are offered on a best-effort basis
  • We make no guarantees regarding third-party platform results (e.g., ad performance, ranking, conversions)
  • You agree not to withhold payment based on subjective expectations unless outlined in writing

We reserve the right to pause or cancel work for non-payment, abusive conduct, or scope creep.

4. Disclaimers

Our services and platforms are provided “as is” and “as available.” We make no warranties, expressed or implied, regarding:

  • Error-free or uninterrupted operation
  • Suitability for a specific purpose
  • The results of any marketing, app, or software service

Use of our services is at your sole risk.

5. Limitation of Liability

To the maximum extent permitted by law, Dead Set Digital and its contractors, affiliates, and partners will not be liable for:

  • Loss of profits, data, reputation, or business opportunities
  • Errors in third-party platforms or integrations (e.g., Meta, Google, Apple, etc.)
  • Any damages exceeding the amount paid to us in the last 90 days

Some jurisdictions don’t allow these limitations — but Texas does, and that’s where we operate.

6. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas. Any disputes related to your use of our services must be resolved exclusively in the courts of Denton County, Texas.

7. Changes to These Terms

We may update these Terms periodically. If we do, we’ll post the new version here with a new effective date. Continued use after changes means you accept the revised Terms.
